Where do we store your personal data?
Personal data is currently stored in the province of Québec (Canada). Your data may be held and used outside of Québec. Consequently, this means that your personal data may be sent or held outside of your own country of residence or your own province (or state) of residence where privacy laws differ. Whenever your data is shared outside of Québec, we will put measures in place to ensure the data is adequately protected.
When your personal data is used or kept outside of your country of residence or your province (or state) of residence, its use becomes subject to the laws applicable in that geographical location, meaning it could be shared with governments, tribunals, law enforcement agencies or regulatory bodies in those places, or shared according to the local laws in effect. Regardless of this, Ngenioâs internal practices regarding your personal data will be governed by this notice and will remain in compliance with applicable privacy laws.
What are your rights concerning your personal data?
We may request proof of identity before fulfilling a request to exercise a right. Proof of personal identification will only be used for this exact purpose.
In the province of Québec, a range of personal data rights are in effect, some of which are:
Data access, removal and correction rights
You may request a copy of any personal data held about you and/or ask to obtain access to it. You may ask us to forward your personal data to an authorized party, subject to certain conditions. For questionnaire respondents, your request will be sent to your employer.
If any of your personal data is inaccurate, incomplete or questionable, you may ask that it be rectified or removed. The same applies when data has been unlawfully collected, shared or stored.
You may also request information on the source of your personal data (when you did not provide it yourself), as well as the names of people who have access to your data and how long it has been held.
Right to withdraw consent at any time
You may withdraw prior consent for us to use and share your personal data.
In the majority of cases, withdrawing your consent means we can no longer process psychometric assessments of you. Beyond this, whenever we ask for consent, we will always inform you of the consequences of refusing to consent.
Provided they follow conditions stipulated by law, a legal resident of the European Union may benefit from enhanced privacy rights, such as:
Restricting the use of your personal data
When its accuracy is being questioned or when its processing is unlawful, you may ask that any processing of your personal data be ceased or suspended.
Data portability
You may ask that your personal data be sent to you in a common machine-readable format, or that it be sent to another party authorized by you.
Data destruction
In specific cases, you may ask for your personal data to be erased, destroyed or removed. Some exceptions apply. A data-controller may refuse such a request when the personal data must be kept in order to comply with the law, with a contractual agreement, or when it relates to a legal claim.
Right to object
In some cases, you may object to the processing of your personal data despite its legal and legitimate use by us (or by a third party) or because of its use for direct marketing purposes.
Refusal of automated processing
You may request that any decisions made concerning or affecting you shall not be made solely based on automated processing, such as profiling, when it could lead to significant legal repercussions concerning or affecting you.
For any further recourse, complaints can be filed with the Data Protection Authorities in our geographical territory, in your own country, province or state of residence, or in the territory where the alleged legal infraction took place.
To exercise any of these rights, kindly send a written request (along with proof of identity) to our Data Protection Officer listed in the section below entitled Need to reach us?
